India introduced law to ban Talaq-e-Biddat

Bill criminalizing triple talaq passed in Lok Sabha.
Introduced, discussed and passed just in half a day. Wow, quick work.

However, the bill will have problems in the Upper House where the ruling party, Bharatiya Janta Party (the Hindu and PM Modi's party) does not have a majority.

I am correct in assuming Talaq-e-Biddat is the Muslim practice of divorcing a woman by saying "I divorce you." three times?

If so, the ban is probably a good thing but I imagine in may not be popular in the Muslim community. They will probably view it as an attack on Islam.

It is welcomed by the Muslim women. It is not liked by the Ulema and Muslim men. Understandable. :)

The law got stuck in the Upper House because BJP does not hqve a majority there. But no problem, there will be another session by end of January. How long can Congress and opposition parties can delay it! They will loose votes.

We have problem on our hands. Supreme Court said 'Talak-e-biddat' is criminal. We have had a few cases since then, but we do not have a law to punish them.

In contrast, Take-e-Bidet is an argument over who gets to keep toilet fixtures in the divorce settlement. :D :D

There is no settlement for the woman in Talaq-e-Biddat other than take the whatever was decided as Mehr money and leave the husbands house. The children remain with the husband. She has to care for children if they are less than two year old. Also, she ha to wit for three months before she can marry again (that is 'iddat', to confirm that she is not pregnant and is not stealing the husband's unborn child).

It was just a joke. I know that the woman is treated like shit and has no rights whatsoever. It is Islam, after all.

I remember a quote in a novel from decades ago. "To be both muslim and female is a fate worse than death."

You often hear the women say "I am not oppressed", or wear signs that say that.

My response is: "Prove it. Do something the mullahs/imams/husband/whatever told you not to do. What do you think oppression means? Resigning yourself to the oppression or accepting it does not mean that you are not oppressed. You still don't have a choice about anything."

SC issues notice in challenge to Polygamy, Nikah Halala

Seven months after it struck down the practice of Triple Talaq, the Supreme Court today issued notice in a batch of petitions challenging the Islamic practices of Polygamy, Nikah Halala, Nikah Mutah and Nikah Misyar.

The petitions, which assail the validity of Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937 insofar as it sanctions the above practices, were heard today by a Bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud.

The Bench, after issuing notice to the Central government and the National Commission for Women, referred the matter to a Constitution Bench.
